The Dividing Fences Act 1991 is an important law to be aware of in NSW. This law is intended to help settle any disputes that may arise as a result of the fence and to provide you with a clear path forward. It effectively regulates your and your neighbor’s responsibility. This legislation is only required if there are disagreements about the proposed fence.
The Swimming Pools Act 1992 specifies the fencing requirements for backyard swimming pools in NSW, as well as other safety requirements such as the display of a CPR sign near the pool. All properties with a swimming pool and/or spa pool must register their backyard swimming pools in an online register provided by the NSW State Government beginning April 29, 2013. Failure to register a swimming pool or spa pool may result in a fine of up to $220.
